Americans with Disabilities Act (ADA) & Digital Accessibility
Civil rights law prohibiting discrimination against individuals with disabilities, applicable to state and local governments (Title II) and places of public accommodation (Title III).
Technical Scope & Purpose
While the original 1990 statute did not mention the internet, federal courts, the U.S. Department of Justice (DOJ), and state laws have consistently affirmed that the ADA applies to digital spaces, including websites, web applications, and mobile apps.
Core Requirements & Success Criteria
Title II (State & Local Governments)
In April 2024, the DOJ published a final rule explicitly mandating WCAG 2.1 Level AA compliance for state and local government digital services, public schools, and community colleges.
Title III (Public Accommodations)
Commercial businesses (retailers, banks, healthcare providers, hospitality, etc.) must ensure effective communication and equal access on their digital channels. Courts consistently look to WCAG 2.1 Level AA as the recognized benchmark.
Effective Communication Rule
Organizations must provide auxiliary aids and services where necessary to ensure that people with disabilities are not excluded or segregated.
Legal Notice & Technical Scope
Technical conformance with WCAG 2.1/2.2 AA is the recognized industry and judicial benchmark for digital accessibility, but technical conformance does not constitute legal immunity.
